This Privacy Policy describes how Easy Spanish with Boris (operated by Boris Byron Mella Carrasco, hereinafter “we,” “us,” or “the Service”) collects, uses, stores, and protects personal information when you visit easyspanishwithboris.cl or use our online language instruction services. By accessing this website or using our services, you agree to the practices described in this Privacy Policy. If you do not agree, please stop using the website and services.

02Information We Collect

2.1 Information you provide voluntarily

We collect personal data when you fill out contact forms, schedule or book classes, enroll in services, or contact us via email. This may include:

  • Full name
  • Email address
  • Phone number (optional)
  • Native language and learning goals
  • Course, instructional hours, attendance, progress records, and assessment results, where you complete a course and receive a certificate of completion
  • Assessed level, skill-level breakdown, and number of live instruction sessions completed, where a Statement of Assessed Level is issued
  • Any information you voluntarily provide

2.2 Information collected automatically

When you visit our website, we may collect technical data such as IP address, browser type and device information, pages visited and time spent, and referring website. This data is used only for security, website functionality, and basic performance analysis. It is not used to identify individual users.

2.3 Free interactive tools and public tests

The free interactive tools (such as the Spanish Basics Trainer) and short public level tests offered on this website operate entirely within your own browser. No name, email address, or other personal data is required or collected, and nothing you enter is transmitted to us, stored on our servers, or retained by us in any form.

Where a tool saves your progress so you can continue later, that information is stored locally in your own browser using browser local storage on your device. It contains no personal identifier, is not accessible to us, and is never transmitted to our servers. Clearing your browser data for this website removes it permanently and immediately. Because it is stored on your device, your progress does not transfer between devices or browsers.

Where a tool generates a downloadable achievement or result image, that image is created in your browser and is not sent to us or retained by us. It carries no verification code and does not form part of our certificate registry.

2.4 Diagnostic and placement tests

Name and assessment results entered into our placement or diagnostic tests are processed entirely within your own browser to generate your results report. This information is not transmitted to our servers, stored in any database, or retained by us in any form.

03How We Use Your Information

We use your data to:

  • Respond to inquiries
  • Provide and manage Spanish classes
  • Send class confirmations or communications
  • Issue and verify certificates of completion and Statements of Assessed Level
  • Improve website performance
  • Comply with legal and tax obligations in Chile

We do not use your data for automated decision-making or profiling.

04Legal Basis for Processing

We process your personal data based on the following legal grounds:

  • Consent — when you submit forms or voluntarily provide information
  • Provision of services — when your data is necessary to provide, manage, and deliver the language learning services you request, including class scheduling, communication, lesson delivery, and certificate issuance and verification
  • Legal obligations — compliance with tax, accounting, and administrative requirements in Chile
  • Legitimate interest — website functionality, security, and basic improvement, provided such interests do not override your fundamental rights and freedoms

Where the student is aged 14 to 17, the legal basis is the enrollment completed by the parent or legal guardian on the student's behalf, as described in Section 11. Sensitive personal data, where applicable, is processed only on the basis of their express consent.

05Third-Party Services

5.1 No sale of data. We do not sell or rent personal data.

5.2 Video platforms. Classes may be conducted using third-party platforms such as Zoom or Google Meet.

5.3 Payment processors. Payments may be processed via PayPal or Wise.

5.4 Analytics. No analytics tools are currently used.

5.5 Scheduling (Calendly). Class scheduling may be handled through Calendly, accessed via external links. Calendly processes the booking information you provide directly on its platform, subject to its own privacy policy at calendly.com/privacy.

5.6 Hosting. Hosting providers may process technical logs for security purposes.

5.7 Contact and enrollment forms (FormSubmit). Website forms may be processed using FormSubmit, a third-party form-delivery service that relays submitted information to our email inbox. FormSubmit does not receive payment or class-content data, only the information you enter into the relevant form.

5.8 Certificate and assessment verification (Google Sheets and Google Apps Script). When a certificate of completion or a Statement of Assessed Level is issued, a record is stored in a private spreadsheet operated through Google Sheets. For certificates of completion this record includes student name, course, instructional hours, score, issue date, and verification code. For Statements of Assessed Level it also includes the assessed level, the skill-level breakdown, and the number of live instruction sessions completed. This spreadsheet is not publicly accessible. Verification of a specific document by its unique code is handled through a private Google Apps Script endpoint, which returns only the record matching the exact code requested; it does not expose the full list of records to the public.

5.9 WhatsApp community group. We operate a community group on WhatsApp where we share free educational materials and updates. Membership is voluntary. Messages sent within the group are subject to WhatsApp's own privacy policy (whatsapp.com/legal/privacy-policy). We do not collect or process personal data from group members beyond what is visible through normal group participation on the WhatsApp platform.

06Cookies and Local Storage

Our use of cookies is described in our Cookie Policy, available at easyspanishwithboris.cl/cookie-policy.

Certain free tools on this website use browser local storage to save your progress on your own device, as described in Section 2.3. This storage is strictly functional, is initiated by your own use of the tool, contains no personal identifier, and is not accessible to us. It is not used for analytics, advertising, tracking, or profiling.

Acceptance of our Terms and Conditions does not constitute consent to the use of non-essential cookies. That consent is obtained separately, through the cookie notice presented on this website, and may be given, refused, or withdrawn at any time independently of those Terms.

07Data Retention

  • Contact inquiries: up to 2 years
  • Student and class records: 6 years from the end of the instruction relationship, in line with Chilean tax and accounting retention requirements
  • Certificate and assessment verification records: retained for as long as the verification service remains active, or until deletion is requested
  • Technical logs: up to 12 months
  • Diagnostic and placement test data: not retained — processed locally in your browser only
  • Free interactive tools and public tests: not retained — no data is collected, and progress is stored only in your own browser

You may request deletion at any time, subject to Section 9 below.

08Data Security

We use reasonable security measures appropriate to the nature of the data processed, including:

  • Restricting access to student and certificate records to private, non-publicly-indexed systems
  • Limiting bulk export or public disclosure of student data; verification of certificates and assessments is performed one record at a time, by code, rather than through open access to the full dataset
  • Using account-level security controls (such as two-factor authentication) on email and administrative accounts where available

No system is 100% secure, and we cannot guarantee absolute security. We will notify affected users and, where legally required, the competent authority, in the event of a data breach affecting personal information.

09Your Rights

You have the right to access, correction, deletion, withdrawal of consent, data portability, and objection to processing.

To exercise any of these rights, contact us at legal@easyspanishwithboris.cl. We will respond to your request within 30 calendar days.

These rights cannot be waived by agreement and remain available to you at all times, regardless of your acceptance of our Terms and Conditions.

If you are not satisfied with our response, you may lodge a complaint with the competent data protection authority — in Chile, the Agencia de Protección de Datos Personales (once operative under Ley N° 21.719), or, in the interim, through the general consumer-protection channels of the Servicio Nacional del Consumidor (SERNAC). If you reside outside Chile, you may also have the right to complain to your local data protection authority.

10International Users

Data may be processed outside your country, including in countries whose data protection laws may differ from those of your country of residence (for example, when using Google Sheets, Google Apps Script, Zoom, PayPal, Wise, FormSubmit, or Calendly, which may store or process data on servers located outside Chile). By using our services, you acknowledge and accept this transfer, without prejudice to any mandatory protections applicable under the law of your country of residence.

11Minors

Our services are intended for individuals aged 14 years or older. We do not knowingly collect, use, or process personal data from individuals under the age of 14.

11.1 Students aged 14 to 17

Enrollment must be completed by the student's parent or legal guardian, who provides the registration data and accepts our Terms and Conditions on the student's behalf, as described in Section 9.2 of those Terms. Administrative communications, payment records, and scheduling data are associated with the parent or legal guardian.

The personal data we process in respect of the minor student is limited to what is necessary to deliver the instruction service: name, level, attendance, progress records, and, where issued, certificate or assessment records.

11.2 Sensitive data

Where a parent or legal guardian voluntarily provides sensitive personal data relevant to learning needs (such as a learning difficulty or health condition), that data is processed only on the basis of their express consent, and only for the purpose of adapting instruction. For students under 16, such consent must be given by the parent or legal guardian in all cases.

11.3 Free tools

The free interactive tools and public tests on this website collect no personal data at all, as described in Section 2.3. No age-verification mechanism applies to them because no personal data is processed.

11.4 Rights of the parent or legal guardian

A parent or legal guardian may request access to, correction of, or deletion of their child's personal data at any time at legal@easyspanishwithboris.cl, under Section 9 of this Policy.

12Limitation of Liability

To the maximum extent permitted by applicable law, and without prejudice to any rights that cannot be waived under Chilean law:

  • Our total liability arising out of or related to the processing of your data shall be limited to what is proportionate to the actual harm caused and permitted under applicable law.
  • We are not responsible for the independent acts, failures, or data practices of third-party services referenced in Section 5, beyond our own selection and reasonable oversight of those providers.
  • Nothing in this section limits or excludes liability for gross negligence, willful misconduct, or any liability that cannot lawfully be limited or excluded.

13Governing Law

This Privacy Policy is governed by the applicable data protection law of the Republic of Chile (currently Ley N° 19.628, transitioning to Ley N° 21.719 upon its entry into force on December 1, 2026), without prejudice to any mandatory data protection rights that may apply under the law of your own country of residence.

14Changes to This Policy

This Policy may be updated from time to time. Updated versions are published on this page and identified by their version number and effective date. Material changes affecting how we process your data will be reflected in a new version.

Previous versions are retained and are available on request at legal@easyspanishwithboris.cl.
