01Website Use

This website provides language learning services and educational materials.

By using this website, you agree to use it only for lawful purposes and in a respectful manner.

You may not use the website to:

• Harass or harm other users or the instructor
• Upload or distribute illegal or harmful content
• Violate intellectual property rights

Access to this website may occasionally be restricted or blocked in certain countries or regions due to network-level restrictions imposed by our hosting provider, which are beyond our control and which the provider has not been able to resolve despite reasonable efforts on our part. Where this occurs, affected users may be able to regain access using a Virtual Private Network (VPN) or similar service, although we cannot guarantee this will work in every case. This limitation relates solely to browsing this website; live classes are conducted through separate third-party platforms (such as Zoom or Google Meet) and are not affected by this restriction. We do not warrant uninterrupted or universally available access to the website from all locations, and such restrictions do not constitute a breach of these Terms. Users are solely responsible for complying with the laws of their own country of residence regarding the use of VPNs or similar tools; we do not encourage or instruct users to circumvent any law applicable to them.

02Nature of the Service and Educational Services

Easy Spanish with Boris is an independent, privately-owned language instruction service operated by Boris Byron Mella Carrasco. It is not an accredited academic institution, and is not affiliated with, recognized by, or certified by any government body, ministry of education, or official language-testing organization (such as the Instituto Cervantes, DELE, or SIELE).

We offer online language classes and educational materials. Class availability may vary depending on scheduling and instructor availability. Course content is provided for educational purposes only.

All instruction is delivered as personalized live instruction: one-on-one classes scheduled directly with the instructor, as described throughout these Terms.

Separately, we make interactive learning tools available on this website, some freely to any visitor and some to enrolled students. These are practice instruments, not courses. They do not constitute enrollment in any program and are described in Section 2.2.

Free trial classes may be offered for new students, limited to one per student unless otherwise stated. Trial classes cannot be scheduled for the last day of the calendar month.

Certificates and diplomas

Any diploma, certificate, or completion document issued by Easy Spanish with Boris attests solely to the completion of our own internal coursework and reflects our own internal assessment. It does not constitute an official academic credential, government-recognized qualification, or standardized proficiency certification, and it should not be relied upon as such for immigration, employment, or academic-accreditation purposes unless independently accepted by the receiving institution or authority.

This diploma or certificate remains a legitimate and verifiable record of the student's language study: it documents the specific course completed, the number of instructional hours completed with the instructor, and the level of proficiency assessed at the time of issuance. It may be used, at the discretion of the receiving party, as supporting evidence of language learning and commitment — for example, in a professional portfolio, resume or CV, job application, or LinkedIn profile.

All diplomas and certificates issued by Easy Spanish with Boris carry a unique verification code that can be checked at any time at easyspanishwithboris.cl/certificate-validation.html, confirming that the document was genuinely issued by us. No interactive tool, automated test, or downloadable image issues a certificate or a verification code, under any circumstance.

2.1 Level Tests, Diagnostic and Placement Assessments

Nature and purpose. We offer written and oral level tests, diagnostic assessments, and placement tests. Some are freely available on this website; others are available only to enrolled students as part of the instruction service. These assessments are designed by Easy Spanish with Boris and evaluate the student's Spanish according to our own criteria and our own instructional program. Their purpose is to estimate a starting point, identify learning priorities, and plan a suitable course of study. They are teaching instruments, not credentials.

No official or standardized value. These assessments are not accredited, official, or standardized proficiency examinations. They are not equivalent to, a substitute for, or predictive of the result of any official examination, including DELE, SIELE, or any assessment administered by the Instituto Cervantes or by any government body or educational authority. A result obtained here does not entitle the student to any officially recognized level, and should not be presented as such for immigration, employment, academic admission, or accreditation purposes.

Reference framework. Where our program or assessments refer to levels A1 to C2, those references describe the scope of curriculum content, using the Common European Framework of Reference (CEFR) — a publicly available descriptive framework published by the Council of Europe — as a content reference only. Such references do not indicate certification, validation, endorsement, or affiliation by the Council of Europe, the Instituto Cervantes, or any other institution.

Results are approximate. Results reflect performance on a specific set of items at a specific moment, under non-supervised conditions in the case of tests taken independently online. They are approximate by design, may not reflect all language skills, and may differ from the outcome of any other assessment. Free tests taken online are provided as-is, without any guarantee of accuracy, availability, or continuity, and no contractual obligation arises from taking them.

Free public tests. Certain short public tests offered on this website provide an automatically generated, approximate level estimate based on a limited number of items. On completion, they may generate a personalized digital image showing that estimate. That image is intended for personal use and sharing on social media. It is an automated estimate, not an evaluation by the instructor: it does not constitute a certificate, diploma, or credential of any kind, does not carry a verification code, and is not a Statement of Assessed Level as described in Section 2.3.

Reassessment after live classes. An initial test result is provisional. Once live classes begin, the instructor may adjust the student's working level or study plan based on direct observation, where that differs from the initial result. Such an adjustment reflects the personalized nature of the service, forms part of normal instructional practice, and does not constitute a change to the service purchased, a defect in the service, or grounds for a refund.

Reports and records. Reports generated by our online tests are created locally in the student's browser and are not stored by us (see Privacy Policy, Section 2.4). These reports do not carry a verification code and do not form part of our diploma and certificate registry.

2.2 Interactive Learning Tools

We make interactive learning tools available on this website. These are practice instruments, not courses. They do not constitute enrollment in any program.

Free tools. Certain tools, such as the Spanish Basics Trainer, are freely available to any visitor. They are provided as-is, without any guarantee of accuracy, availability, or continuity, and may be modified, restricted, or discontinued at any time without notice. No contractual obligation arises from their use. On completion, some free tools generate a personalized digital achievement image showing a score or completion status. That image is intended for personal use and sharing on social media. It does not constitute a certificate, diploma, or credential of any kind, does not attest to any level of proficiency, and does not carry a verification code.

Student tools. Other tools are made available only to enrolled students as a complementary component of the paid instruction service, subject to availability. Access depends on the website being reachable from the student's location. As described in Section 1, access may be restricted in certain regions due to hosting-provider limitations beyond our control. These tools do not form part of the core paid service, which consists of the live classes and related materials delivered through external platforms (such as Zoom or Google Meet) that are not affected by such restrictions. Accordingly, any inability to access them — whether due to regional access restrictions, temporary technical issues, or their being modified or discontinued — does not constitute a breach of these Terms and does not give rise to a refund.

2.3 Statement of Assessed Level

In addition to certificates of completion, the instructor may issue a Statement of Assessed Level, a separate document recording the instructor's professional assessment of a student's Spanish at a given point in time.

Basis of the assessment. The assessment is made by the instructor, a native Spanish speaker, in his professional capacity as the designer and lead instructor of our program. It is based on direct observation of the student across completed live instruction sessions, together with the internal assessment instruments described in Section 2.1. The criteria applied are those of our own instructional program, which is structured with reference to the Plan Curricular del Instituto Cervantes (PCIC) and the Common European Framework of Reference (CEFR) — both publicly available documents used here as content references only. Such references do not indicate certification, validation, endorsement, or affiliation by the Instituto Cervantes, the Council of Europe, or any other institution.

Issuance. A Statement of Assessed Level is issued at the sole discretion of the instructor, when in his professional judgement the student's level can be reliably assessed on the basis of sustained direct observation across completed live instruction sessions. It is not issued on the basis of an online test result alone, and it is not automatically generated on completion of any course, package, or number of sessions. It does not form part of any course package, is not included in the price of any service, and is not a deliverable of the instruction agreement. No student is entitled to its issuance, and a decision not to issue it does not constitute a breach of these Terms or grounds for a refund.

Levels and terminology. The level recorded uses our own program terminology (Basic Spanish Level 1 and 2, Intermediate Spanish Level 1 and 2, Advanced Spanish Level 1 and 2). Where a corresponding CEFR band is shown, it describes the scope of curriculum content covered and is provided as a content reference only.

Point-in-time validity. The document records the level assessed as of the date of issuance. Language proficiency changes with use and with time; the statement does not certify the student's level at any later date and carries no expiry-free validity.

Status. A Statement of Assessed Level is an internal evaluation issued by a private, non-accredited instruction service. It is not an official, accredited, or standardized proficiency certification. It is not equivalent to, a substitute for, or predictive of the result of any official examination, including DELE or SIELE, and it should not be relied upon for immigration, employment, or academic-accreditation purposes unless independently accepted by the receiving institution or authority. It represents the instructor's professional opinion, expressed in good faith on the basis described above, and does not guarantee performance in any other assessment or context.

Each Statement of Assessed Level carries a unique verification code that can be checked at easyspanishwithboris.cl/certificate-validation.html. A Statement of Assessed Level is the only document issued by Easy Spanish with Boris that records an assessed level of Spanish. No automated test, tool, or downloadable image issued by this website constitutes such a statement, regardless of any level or score it may display.

03Personalization

All classes are personalized and specially designed for each student based on their level, age, interests, and learning goals.

3.1 Class Duration and Instructional Hours

Each live class session is scheduled for 50 minutes, corresponding to one hora lectiva (instructional hour) as defined in the Instituto Cervantes reference framework. Where a session's planned learning objectives are met before the full scheduled time has elapsed, the remaining time is available to the student for review, conversation practice, or clarification, at the student's request. Sessions are not shortened below the scheduled duration except by agreement with the student, or where the student chooses to conclude the session early.

For curriculum-planning purposes, our program structure uses this same reference: one instructional hour of curriculum content corresponds to one class session. This reference is used to plan and describe the scope of curriculum content covered by a course or level.

Accordingly, where these Terms or any diploma or certificate refer to a number of “instructional hours,” that figure describes the number of scheduled 50-minute class sessions completed, planned on the basis described above.

3.2 Nature of the Instructional Commitment

The instructor undertakes to deliver the scheduled sessions and the corresponding curriculum content with professional diligence and care, and to assess the student's progress according to the criteria of our own program.

Language acquisition depends on factors outside the instructor's control, including the student's individual pace and aptitude, attendance, and practice undertaken between sessions. Accordingly, no specific level of proficiency, learning outcome, examination result, or rate of progress is guaranteed, and none is offered as a term of this agreement. Any level, timeframe, or progression described in course materials is a planning estimate based on typical progress, not a promise of individual result.

04Payments

Course payments must be made through PayPal or Wise.

05Refund Policy

This refund policy applies to paid, personalized live-instruction courses. Free interactive tools, free tests, and free themed classes involve no payment and are not eligible for a refund.

• If the student cancels before the course begins, the amount paid will be refunded with a 25% deduction, covering payment-processing and currency-conversion fees that are not recovered by the provider, together with tax amounts already withheld and remitted to the Chilean tax authority (Servicio de Impuestos Internos) in respect of that payment.
• If the student cancels after the course has started, the value of the remaining classes in the package will be refunded with a 35% deduction for class personalization and materials already prepared.
• Refund requests must be submitted within 10 calendar days of the purchase date. Requests submitted after this period will not be accepted, regardless of the number of classes remaining in the package. This limitation exists because tax withholdings on service fees are declared and remitted monthly to the Chilean tax authority (Servicio de Impuestos Internos) and are not recoverable once paid.
• By submitting a refund request, the student agrees that the refund will be issued exclusively via PayPal or Wise. The student must include their PayPal or Wise payment link or associated email address when submitting the request.

5.1 Right of Withdrawal

The parties expressly agree that the right of unilateral withdrawal established in Article 3 bis (b) of Chilean Ley N° 19.496 does not apply to these services. Termination and refunds are governed exclusively by this Section 5.

06Refund Processing

Once the request is received, the instructor will respond within 5 business days.

Once approved, the refund will be processed within 15 business days.

07Class Schedule Changes and Package Validity

Students may reschedule their classes with at least 24 hours' notice. This change must be made through the external provider managing class scheduling.

Each course package includes one late-notice reschedule at no cost, which the student may use at any time during the package. Beyond that allowance, a class rescheduled with less than 24 hours' notice cannot be guaranteed and may be counted as delivered.

7.1 Course package validity

Course packages must be used within 6 calendar months of the date of purchase, calculated from the payment date regardless of when the first class is scheduled.

Classes not scheduled and completed within this period expire at the end of that period without refund or credit. The student is responsible for scheduling classes within the validity period; the instructor is not obligated to proactively contact the student regarding remaining classes.

08Instructor Cancellations

The instructor will make every effort to honor scheduled classes. In case of cancellation due to unforeseen circumstances, the student will be notified and the session will be rescheduled at no additional cost.

09Age Requirement and Minor Students

Our services are intended for individuals aged 14 years or older. We do not knowingly collect, use, or process personal data from individuals under the age of 14, and we do not offer classes to students under that age.

This 14-year minimum applies to services that involve the collection or processing of personal data, including live classes, diagnostic and placement assessments, and diploma or certificate issuance. The free interactive tools and free tests offered on this website do not collect, transmit, or store any personal information — all processing occurs locally within the user's own browser and nothing is retained by us. These tools are designed with learners aged 14 and older in mind, but since no personal data is involved, no age-verification mechanism applies to them.

9.1 Adult students (18+)

Students who are 18 years of age or older may enroll, pay, and accept these Terms and Conditions directly, on their own behalf.

9.2 Minor students (14–17)

Students between 14 and 17 years of age may take classes, but enrollment must be completed by the student's parent or legal guardian, who is responsible for:

• Completing the registration and payment in their own name;
• Reading and accepting these Terms and Conditions on the student's behalf;
• The accuracy of the information provided, including the student's age; and
• Reasonable supervision of the minor's participation in classes.

Class confirmations, payment receipts, scheduling changes, and any other administrative communication will be directed to the parent or legal guardian's contact information. The minor student may communicate directly with the instructor for matters strictly related to class content (such as questions about homework), but any change to enrollment, payment, or cancellation must be requested by the parent or legal guardian.

In accordance with applicable data protection law, personal data of students aged 14 to 17 may be processed on the basis of the enrollment described above; sensitive personal data (such as health information relevant to learning needs), where applicable, requires the express consent of the parent or legal guardian for students under 16.

9.3 Verification and misrepresentation of age

If it is determined that a student misrepresented their age, or that a student under 18 enrolled without the involvement of a parent or legal guardian as described in Section 9.2, or that a student is under 14, access to the service will be terminated immediately. Refund treatment for such cases is governed exclusively by Section 5 (“Age requirement and refunds”).

By using this website, booking a class, or submitting any form on behalf of a minor, the parent or legal guardian confirms that they hold that role with respect to the student and accepts these Terms and Conditions accordingly. By using this website, booking a class, or submitting any form on their own behalf, an adult user confirms that they are at least 18 years old.

10Free Themed Classes and Recording

The instructor offers free classes open to any interested participant, covering a topic selected by the instructor. These classes are an independent service provided at no cost and with no obligation to purchase any paid package. They are distinct from the free trial class described in Section 5.

10.1 Recording

These classes may be recorded by the instructor for use in promotional materials, social media, website content, or other marketing purposes. By registering for or attending a free themed class, participants acknowledge and accept that the class may be recorded and that recordings may be used for these purposes without further notice, compensation, or approval. The instructor will announce verbally at the start of each session that the class will be recorded and published.

10.2 Authorization of image and voice

By attending a free themed class with their camera on, participants grant the instructor an express, royalty-free, and territorially unrestricted authorization to use their image, voice, and name in the promotional materials described above, including social media, website, and digital advertising, for an indefinite period, unless a deletion request is submitted within the period specified in Section 10.4.

Participants who do not wish their image to be recorded or published must keep their camera and microphone off for the duration of the class. Keeping the camera off does not affect participation in any way.

10.3 No compensation

Participation in a free themed class does not entitle any participant to compensation, revenue sharing, or any other benefit arising from the use of recordings, regardless of the extent to which recordings are used for commercial or promotional purposes.

10.4 Deletion requests

Participants may request the removal of their image or voice from a recording by contacting legal@easyspanishwithboris.cl within 30 calendar days of the class date. Requests submitted after this period cannot be guaranteed, as the material may already have been published and distributed across third-party platforms.

10.5 Minors

Free themed classes are intended for participants aged 18 years or older. Participants under 18 may not attend with their camera on without prior written authorization from their parent or legal guardian that expressly includes consent to the recording and use of the minor's image as described in this Section.

10.6 Third-party platforms

Classes are conducted through third-party videoconferencing platforms such as Zoom. When recording is activated, such platforms may display an automatic recording notice to participants. This notice is in addition to, and does not replace, the consent given under these Terms.

11Intellectual Property

All content on this website, including lessons, texts, images, videos, and other materials, is the property of the website owner unless otherwise stated. You may not copy, reproduce, distribute, or use the content for commercial purposes without prior written permission.

This includes the interactive tools, assessment instruments, question banks, and curriculum structure made available on this website. Making certain tools freely accessible does not transfer any right in them, nor does it authorize their reproduction, redistribution, adaptation, or commercial use.

12Limitation of Liability

To the maximum extent permitted by applicable law, and without prejudice to any rights that cannot be waived under the Chilean Consumer Protection Law (Ley N° 19.496) or other mandatory law applicable to the student:

• The website owner's total liability arising out of or related to these Terms or the services provided shall not exceed the total amount paid by the student for the specific course or package giving rise to the claim.
• The website owner is not liable for indirect, incidental, or consequential damages (such as loss of profits or opportunities) arising from the use of the website or its services.
• Nothing in this section limits or excludes liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by negligence, nor any liability that cannot lawfully be limited or excluded.
• The website owner is not responsible for technical issues, interruptions, or errors on the website that are beyond its reasonable control, provided reasonable efforts are made to resolve them within a reasonable time.

14Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Chile.

Any dispute arising from or related to these Terms or the services provided shall be submitted to the competent ordinary courts of Chile, or, where applicable, resolved through the consumer protection mechanisms provided by the Chilean Servicio Nacional del Consumidor (SERNAC) under Ley N° 19.496.

Nothing in this clause affects the jurisdiction of the Juzgado de Policía Local corresponding to the consumer's domicile, as established in Article 50 A of Ley N° 19.496, where that provision is applicable.

This clause does not deprive students who qualify as consumers under the mandatory law of their own country of residence of any protection that such law grants them and that cannot be waived by agreement.

15Modifications

We may update these Terms and Conditions from time to time. Updated versions are published on this page and identified by their version number and effective date.

Modifications apply only to course packages purchased on or after the effective date of the updated version. They do not apply retroactively: any course package already purchased remains governed, for its full duration, by the version of these Terms in force and accepted by the student at the time of purchase.

Continued use of this website after an updated version takes effect constitutes acceptance of that version in respect of website use and any future purchase. It does not modify the terms of a course package already purchased.

Previous versions of these Terms are retained and are available to any student on request at legal@easyspanishwithboris.cl.

17Entire Agreement and Severability

These Terms and Conditions constitute the entire agreement between the student and the instructor in relation to the instruction services described. The Privacy Policy and Cookie Policy govern data protection and cookie use respectively, and apply alongside these Terms.

If any provision of these Terms is found to be invalid, void, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

A Spanish-language version of these Terms is available on request at legal@easyspanishwithboris.cl. In the event of any discrepancy, and where Chilean consumer protection law applies, the Spanish version shall prevail.

18Acceptance of These Terms and Related Policies

By enrolling in a course, submitting a booking or contact form, making a payment, or otherwise using the services described in these Terms, you confirm that you have read, understood, and accepted these Terms and Conditions.

You further confirm that you have been given the opportunity to read our Privacy Policy and our Cookie Policy, both permanently available on this website, and that you understand how your personal data is collected, used, retained, and protected as described in the Privacy Policy.

Where a course package is purchased on behalf of a student aged 14 to 17, the parent or legal guardian completing the enrollment gives this confirmation on the student's behalf, in accordance with Section 9.2.

Cookies. Acceptance of these Terms does not constitute consent to the use of cookies. Consent to non-essential cookies is obtained separately, through the cookie notice presented on this website, and may be given, refused, or withdrawn at any time independently of these Terms.

Data protection rights. Nothing in this acceptance waives any right granted to you under applicable data protection law, including your rights of access, rectification, deletion, and objection as described in the Privacy Policy. These rights cannot be waived by agreement and remain available to you at all times.

Free tools and public tests. Use of the free interactive tools and public tests offered on this website does not require enrollment, payment, or the submission of personal data, and does not create a contractual relationship. Use of these tools is subject to these Terms, which are permanently accessible from this website, and to the Cookie Policy in respect of local storage and cookies. No acceptance mechanism is presented for these tools because no personal data is collected and no service is contracted through them.
